DENPASAR – Persidangan perkara perdata nomor 397/Pdt.G/2026/PN Dps di Pengadilan Negeri Denpasar mengungkap sejumlah kejanggalan, terutama terkait dokumen Sertifikat Hak Milik (SHM) pengganti yang dipersoalkan para pihak.
Dalam sidang yang digelar pada 4 Mei 2026, kuasa hukum tergugat, Indrawati, menyampaikan keberatan atas proses persidangan yang dinilai berlangsung terlalu cepat. Mereka memprotes karena agenda sidang telah memasuki tahap pembuktian, meskipun panggilan pertama kepada tergugat diakui belum diterima.
Perdebatan sempat terjadi antara kuasa hukum tergugat dan majelis hakim. Ketua majelis mengakui adanya kendala dalam pemanggilan, namun menyatakan agenda pembuktian tidak dapat diubah. Sebagai jalan tengah, majelis kemudian memutuskan agar para pihak menempuh proses mediasi yang dipimpin oleh salah satu hakim anggota.
Kuasa hukum Indrawati, Somya, menilai keputusan tersebut tidak lazim. Ia menyebut kliennya kehilangan hak untuk memberikan jawaban dan duplik dalam proses persidangan.
“Rasanya ini pertama kali kami temui, hakim anggota ditunjuk sebagai mediator saat sidang sudah masuk agenda pembuktian. Klien kami kehilangan hak jawab dan pembelaan, ini sangat kami sesalkan,” ujar Somya.
Mediasi kemudian dijadwalkan pada 6 Mei 2026. Dalam proses tersebut, pihak tergugat kembali menemukan hal yang dianggap janggal terkait SHM pengganti yang diajukan penggugat.
Menurut Somya, dalam mediasi ditunjukkan dokumen SHM pengganti yang disebut telah terbit dan ditandatangani pada 9 Januari 2026. Namun, ia mengungkapkan bahwa sebelumnya, pada 16 Februari 2026, dokumen yang sama belum memuat tanda tangan.
Lebih lanjut, Somya juga menyebut bahwa sebelum sidang mediasi, pihaknya sempat menerima informasi dari salah satu kuasa hukum bahwa SHM tersebut baru ditandatangani pada April 2026.
“Ini sangat aneh dan terkesan dikondisikan. Kami berharap majelis hakim melihat bahwa perkara ini tidak sesederhana yang tertuang dalam gugatan. Sejak awal sudah penuh kejanggalan,” tegasnya.
Pihak tergugat menyatakan akan menempuh langkah lanjutan dengan mengajukan permohonan perlindungan hukum. Mereka menduga adanya keterlibatan oknum dalam institusi pertanahan negara dalam proses penerbitan SHM pengganti tersebut.
