DENPASAR — Upaya penyelesaian kasus secara Restorative Justice (RJ) antara April Jumadil Awal (Laura) Warga Negara Indonesia (WNI), dengan Warga Negara Spanyol bernama Gonzalo Antonio Sanzhez Villa, berakhir tanpa hasil. Padahal, Laura telah membayar uang ganti rugi sebesar Rp150 juta sebagai bagian dari kesepakatan damai yang disetujui bersama.

Kuasa hukum Laura, Niran Nuang Ambo, SH., MH., bersama Sri Kinanti Rahayu Kasman, SH., dari Centrale Law Firm, mengungkapkan bahwa seluruh syarat dan ketentuan RJ telah dipenuhi. Namun hingga kini, proses penyelesaian tersebut tak kunjung terealisasi, sementara uang yang telah diserahkan pun tak dikembalikan.
“Klien kami sudah membayar Rp150 juta untuk pelaksanaan Restorative Justice, tapi faktanya tidak dijalankan dan tak ada kejelasan dari penyidik. Ini sangat merugikan”
Laura telah memenuhi permintaan kesepakatan damai dan RJ disaksikan oleh pihak Kepolisian.
“Kerugian yang terlihat pada propertinya itu tidak lebih dari Rp1 juta, Laura telah menyepakati permintaan dari Gonzalo,” ujar Niran di Denpasar.
Lebih jauh, pihaknya menduga adanya indikasi pelanggaran etik oleh oknum penyidik Unit I Polres Badung. Oknum tersebut diduga meminta tambahan uang Rp50 juta dengan janji agar RJ segera dilaksanakan, serta memaksa kliennya menandatangani surat tanpa sepengetahuannya.
“Oknum itu menjanjikan RJ akan berjalan jika surat itu dikirim. Tindakan seperti ini sudah melewati batas kewenangan,” tegas Niran.
Akibat kejadian tersebut, pihak kuasa hukum melaporkan itu ke Bidpropam Polda Bali, dengan tembusan ke Kapolda Bali, Ombudsman, hingga Mabes Polri. Sementara Gonzalo Antonio Sanzhez Villa kini juga dilaporkan ke Polda Bali atas dugaan penipuan dan penggelapan sesuai Pasal 372 dan 378 KUHP.

Kuasa hukum Sri Kinanti menambahkan bahwa mereka memiliki bukti kuat berupa surat perjanjian, surat pernyataan damai, dan rekaman video yang menunjukkan kesepakatan RJ memang telah dibuat dan disaksikan penyidik. “Tapi sayangnya, hingga kini RJ tidak dilaksanakan dan kasus malah dilimpahkan ke Kejaksaan Negeri Badung,” ujarnya.
Pihaknya berharap Kejaksaan dapat meninjau kembali berkas perkara tersebut dengan mempertimbangkan adanya kesepakatan damai yang sah. “Klien kami sudah memenuhi semua kewajiban untuk RJ, tapi justru menjadi korban. Hukum seharusnya berpihak pada keadilan, bukan pada kepentingan tertentu,” tegasnya.
Kuasa hukum juga menuntut agar uang Rp150 juta segera dikembalikan, serta meminta agar aparat penegak hukum menindak tegas oknum yang diduga menyalahgunakan kewenangan. “Jangan sampai hukum di negeri ini tampak memihak WNA, sementara hak-hak warga negara sendiri diabaikan,” pungkas Niran.
