DENPASAR – Polemik yang mencuat pasca penyerahan dua rekomendasi hasil pengawasan Panitia Khusus Tata Ruang, Aset, dan Perizinan (Pansus TRAP) DPRD Bali mendapat sorotan serius dari kalangan akademisi hukum.
Pakar Hukum Pemerintahan, Dr. Made Jayantara, S.H., M.H., MAP., CLA., mengingatkan agar seluruh pihak, khususnya pimpinan DPRD Bali, berhati-hati dalam menyikapi rekomendasi tersebut agar tidak menimbulkan persoalan hukum baru di kemudian hari.
Menurut Dr. Jayantara, dalam perspektif Hukum Administrasi Negara, izin yang telah diterbitkan pemerintah merupakan keputusan tata usaha negara yang bersifat individual, konkret, dan final atau dikenal dengan istilah vergunning konkret. Karena itu, pencabutan maupun pembatalannya tidak dapat dilakukan secara serampangan hanya berdasarkan rekomendasi politik.
“Harus dikembalikan pada kewenangannya. Pansus TRAP dibentuk DPRD untuk menjalankan fungsi pengawasan terhadap eksekutif, bukan terhadap masyarakat atau pelaku usaha. Hasil temuan pansus seharusnya diserahkan kepada eksekutif untuk ditindaklanjuti sesuai mekanisme hukum yang berlaku,” ujar Dr. Jayantara, Selasa (2/6/2026).
Ia menegaskan, apabila rekomendasi tersebut digunakan sebagai dasar untuk mengambil tindakan di luar koridor hukum administrasi negara, maka berpotensi memunculkan tudingan penyalahgunaan wewenang (abuse of power) hingga tindakan sewenang-wenang (arbitrary action) yang justru dapat menimbulkan sengketa baru.
Dr. Jayantara mencontohkan polemik yang berkembang terkait kawasan Kura Kura Bali. Menurutnya, pihak pengelola saat ini menjalankan kegiatan berdasarkan izin yang telah diterbitkan pemerintah.
Karena itu, apabila terdapat pihak yang ingin membatalkan atau mencabut izin tersebut, mekanisme yang harus ditempuh adalah melalui prosedur hukum administrasi dan sengketa Tata Usaha Negara (TUN), bukan melalui tekanan politik ataupun opini publik.
“Kalau ada izin yang dianggap bermasalah, ada mekanisme hukumnya. Tidak bisa begitu saja dicabut. Negara hukum mengharuskan setiap keputusan administrasi diperiksa melalui prosedur yang diatur undang-undang,” tegasnya.
Lebih lanjut, Dr. Jayantara mengingatkan bahwa rekomendasi Pansus TRAP pada dasarnya hanyalah instrumen pengawasan yang tidak memiliki kekuatan mengikat secara hukum. Keputusan akhir tetap berada pada ranah eksekutif dengan mempertimbangkan seluruh aspek regulasi dan konsekuensi hukumnya.
“Rekomendasi itu sifatnya tidak mengikat. Disampaikan kepada gubernur untuk menjadi bahan pertimbangan. Dipakai atau tidak, tidak ada sanksi hukum. Bahkan tanpa rekomendasi sekalipun, eksekutif tetap dapat bertindak apabila ditemukan pelanggaran berdasarkan ketentuan hukum yang berlaku,” katanya.
Karena itu, ia meminta seluruh pihak mengedepankan prinsip kehati-hatian dan kepastian hukum agar tidak muncul preseden buruk yang berpotensi mengganggu iklim investasi, merugikan pihak yang telah mengantongi izin resmi, serta menyeret berbagai pihak ke dalam pusaran konflik hukum berkepanjangan.

Sementara itu, Ketua DPRD Bali Dewa Made Mahayadnya atau yang akrab disapa Dewa Jack menegaskan bahwa rekomendasi yang diserahkan kepada Pemerintah Provinsi Bali merupakan hasil pendalaman, investigasi lapangan, pemeriksaan dokumen, serta serangkaian rapat dan konsultasi yang dilakukan Pansus TRAP dalam menjalankan fungsi pengawasan.
“Nah, dalam dua rekomendasi ini, kita telah menetapkan dan memutuskan untuk menyampaikan kepada eksekutif atau gubernur. Dalam kajian Pansus TRAP tentu ada hal-hal yang harus disikapi secara serius dengan mempertimbangkan aturan yang berlaku,” ujarnya.
Pernyataan tersebut sekaligus menegaskan bahwa tindak lanjut rekomendasi tetap berada dalam kewenangan pemerintah daerah sebagai pemegang otoritas eksekutif, yang wajib memastikan setiap kebijakan dan keputusan tetap berjalan sesuai prinsip negara hukum, asas kepastian hukum, serta perlindungan terhadap hak-hak yang lahir dari izin yang sah.
