Kuasa Hukum Nilai Jaksa Tidak Cermat, Tuntutan Terhadap Leni Yuliastari Dinilai Tak Didukung Fakta Persidangan

DENPASAR – Kasus penganiayaan sampai terbunuhnya I Pande Gede Putra Palguna (53) yang disidangkan di Pengadilan Negeri (PN) Denpasar, berawal dari kasus hutang piutang yang menjerat korban yang ramai di media sosial membuat salah satu kuasa hukum I Gusti Gede Putu Atmaja, SH., MH., yang berkantor di Ambara Law Office angkat bicara.
I Gusti Ayu Leni Yuliastari (57) kliennya disebutkannya meminta bantuan Ida Ayu Oka Suryani Mantara (38), dan Intan Oktavia Pusparini (39) yang memiliki kemampuan tarot, untuk dapat digunakan membujuk korban agar mau bertemu dan mengembalikan uang miliknya.
Jaksa Penuntut Umum (JPU) Kejati Bali Dewa Anom Rai menuntut masing-masing terdakwa dijatuhi pidana penjara selama 10 tahun.
“Menuntut supaya majelis hakim yang memeriksa dan mengadili perkara ini menyatakan terdakwa telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana yang menyebabkan trauma yang mendalam bagi keluarga korban,” ujar JPU.
Disini Tim penasihat hukum Terdakwa menilai Jaksa tidak cermat dalam menyusun tuntutan atas perkara kematian I Pande Gede Putra Palguna, pria bertato tersebut. Bahwa kliennya tidak memiliki niat maupun peran langsung dalam menghilangkan nyawa korban.
Kuasa hukum yang terdiri atas I Gusti Gede Putu Atmaja, S.H., M.H., Gede Agra Kumara, S.H., M.H., dan Rozi Maulana, S.H., menilai dakwaan jaksa yang menggunakan Pasal 338 KUHP dan Pasal 353 ayat (3) junto Pasal 55 KUHP tidak tepat serta tidak ditopang bukti kuat. Mereka menegaskan, seluruh saksi di persidangan tidak satu pun melihat atau mendengar adanya keterlibatan langsung terdakwa dalam tindak kekerasan yang menyebabkan kematian korban.
Ia juga menerangkan bahwa saksi di TKP juga tidak mendengar adanya jeritan penyiksaan korban. Belum lagi tidak terbuktinya ada perintah dari Leni Yuliastari kepada kedua terdakwa untuk menganiaya korban.
“Itu spontanitas dari terdakwa 2 dan 3 karena rasa kesal kepada korban karena telah banyak menipu dan membuat janji palsu”
Hal ini pelaku tidak harus memiliki niat membunuh meskipun korban meninggal dunia, niat mens rea nya tetap melakukan penganiayaan namun bukan niat melakukan pembunuhan karena ada hal yang ingin pelaku dapatkan, agar korban membayar hutangnya.
“Tidak juga ada niatan membunuh. Klien kami hanya ingin menagih uang hasil bisnis yang macet, bukan melakukan kekerasan. Bahkan, klien kami sempat meminta agar korban tidak dianiaya,” ujar Atmaja yang akan dituangkan dalam pledoinya, Kamis, 16 Oktober 2025.
Dalam fakta persidangan juga menunjukkan, korban masih bisa keluar masuk kamar kos tempat kejadian tanpa pengawalan ketat. Hal ini, menurut tim pembela, membantah dakwaan jaksa tentang dugaan perampasan kemerdekaan sebagaimana diatur dalam Pasal 333 KUHP.
Selain itu, penasihat hukum menilai JPU mengabaikan asas pertanggungjawaban pidana yang bersifat individual. “Perbuatan penganiayaan dilakukan secara spontan oleh pihak lain, tanpa perintah atau keterlibatan langsung dari klien kami. Jaksa seharusnya lebih cermat meneliti konstruksi peran setiap terdakwa,” tegas mereka.
Gusti Atmaja juga menyoroti bahwa korban bukan semata-mata korban, melainkan pihak yang sebelumnya diduga menipu sejumlah orang dalam transaksi jual beli hotel senilai miliaran rupiah. “Klien kami justru menjadi salah satu pihak yang dirugikan juga, Leni Yuliastari hanya ingin uangnya kembali,” tambahnya.
Melalui pledoi yang akan dibacakan selasa 21 Oktober 2025, kuasa hukum meminta majelis hakim menjatuhkan putusan bebas atau setidaknya melepaskan terdakwa dari segala tuntutan hukum sesuai fakta persidangan.
Mereka menutup pembelaan dengan menegaskan asas in dubio pro reo, yakni setiap keraguan dalam pembuktian harus ditafsirkan untuk kepentingan terdakwa, sehingga terdakwa harus dibebaskan dari dakwaan. (Ray)
