GIANYAR – Sidang perkara sengketa tanah di kawasan Subak Petulu Andong kembali bergulir di Pengadilan Negeri Gianyar, Senin (15/12/2025). Agenda pemeriksaan saksi justru membuka tabir lama penguasaan lahan yang kini disengketakan, sekaligus memunculkan tudingan serius soal praktik mafia tanah yang dinilai merugikan masyarakat kecil.
Dalam persidangan tersebut, majelis hakim mendengarkan keterangan saksi yang dihadirkan pihak tergugat. Salah satu saksi kunci, Made Nengah Sutarja (60), warga Peliatan, Gianyar, secara gamblang memaparkan riwayat kepemilikan dan batas-batas tanah yang menjadi objek sengketa. Ia mengaku mengetahui langsung sejarah lahan tersebut dari cerita pemilik sebelumnya saat dirinya bekerja sebagai petani di area persawahan sekitar lokasi.
Di hadapan majelis hakim, saksi menegaskan bahwa tanah tersebut sejak awal merupakan milik leluhur Tergugat, Ir. Anak Agung Rama Pujawan Dalem. Ia juga membenarkan adanya transaksi jual beli puluhan tahun lalu.
“Saya tahu tanah itu milik Gung Rama dari leluhurnya. Sebagian sudah dijual kepada Bapak Lagi seluas 32 are, dan sisanya sekitar 14,8 are masih milik Gung Rama,” ungkap saksi dengan tegas.
Tergugat Ir. Anak Agung Rama Pujawan Dalem, S.H., M.H., MCI., yang juga menjabat sebagai Ketua DPD ARUN Bali, menjelaskan bahwa kesaksian tersebut memperkuat posisi hukumnya. Menurutnya, saksi menyebut sebagian bidang tanah memang telah dialihkan kepemilikannya sejak era 1980-an, sementara sisa lahan masih sah dikuasai tergugat dan dilengkapi Sertifikat Hak Milik (SHM).
“Sidang berjalan sekitar 45 menit. Saksi menceritakan tanah tersebut berasal dari Puri Kaleran, dibeli sekitar tahun 80-an, lengkap dengan batas-batasnya. Ia juga menegaskan bahwa tanah 32 are sudah terjual dan 14,8 are masih milik saya,” ujarnya usai persidangan.
Menemui kuasa hukum saat sidang berakhir, Dr I Nyoman Nadayana SH MH dari Bali World Legal Service menerangkan bahwa sidang kali ini adalah mendengarkan kesaksian dari saksi tergugat.
“Saksi menjelaskan apa yang menjadi pengalaman dirinya, bagaimana sejarah tanah tersebut karena saksi tinggal tidak jauh dari lokasi sengketa, ” Ungkapnya.
Ia juga menjelaskan bahwa penggugat mengklaim bahwa tanah tersebut miliknya tetapi bukti – bukti yang digunakan hanyalah pembayaran pajak.
Kuasa hukum lainnya Dewa Putu Adnyana SH MH dari Dewa Adnyana & Partner Law Office menekankan bahwa kliennya memiliki SHM atas tanah sengketa tersebut, SHM merupakan hak milik yang mengikat.
“Secara teoritis dan normatif klien kami memiliki SHM dari semua obyek sengketa, kami menyerahkan kepada majelis hakim untuk menilai, ” Jelasnya.

Aryawan juga menyoroti lemahnya dasar gugatan pihak penggugat yang disebut hanya mengandalkan bukti Pajak Bumi dan Bangunan (PBB), berbanding terbalik dengan tergugat yang mengantongi sertifikat hak milik. Ia mengungkap informasi bahwa penggugat diduga pernah melakukan pola serupa terhadap warga lain, bahkan menawarkan pembagian tanah agar perkara tidak berlanjut ke jalur hukum.
“Tidak bisa hanya bermodal pajak lalu mengklaim tanah orang lain. Ini cara-cara menakuti masyarakat kecil yang tidak paham hukum. Kami mengutuk keras praktik mafia tanah di Bali yang mendzolimi rakyat. Kasus ini akan kami lawan sampai selesai dan kami laporkan ke ARUN Pusat,” pungkasnya.
