Gugatan Tindakan Perbuatan Melawan Hukum Sengketa “Batu Ampar” , Gede Indria: Kita Meluruskan

Pemkab Buleleng Layangkan Gugatan PMH demi Cari Kepastian Hukum dan Meluruskan Pembatalan HPL Batu Ampar.
BULELENG – Sidang lanjutan sengketa lahan Batu Ampar di Banjar Dinas Batu Ampar, Desa Pejarakan, Kecamatan Gerokgak, Kabupaten Buleleng dengan perkara Perdata Nomor 495/Pdt.G/2026/PN.Sgr., Selasa 11 Agustus 2026, memasuki babak penyerahan gugatan oleh tim kuasa hukum Pemkab Buleleng.
Menemui salah satu tim kuasa hukum penggugat Ketut (Jack) Suartana menerangkan bahwa para tergugat belum siap terhadap jawaban gugatan.
“Tergugat mohon penundaan jawaban gugatan kepada Majelis Hakim, namun belum ada ACC dari Majelis Hakim, ” Terang Jack.
Ia juga menerangkan bahwa tujuan dari gugatannya adalah mencari kepastian hukum dari status obyek sengketa dengan mempermasalahkan isi putusan no. 59 tahun 2010 dimana pihak Pemda (Pemkab Buleleng) tidak ikut sebagai tergugat, namun putusan tersebut dipakai sebagai dasar hukum untuk membatalkan sertifikat HPL 0001 di PTUN.

“Kami juga mempermasalahkan putusan PTUN dimana penggugat hanya mempermasalahkan obyek sengketa hanya 8 hektar tetapi kenapa seluruh HPL seluas 45 hektar dibatalkan semuanya, ” Jelasnya.
Lebih lanjut, Gede Indria secara terpisah memperdalam penjelasan isi gugatan bahwa dasar dari petitum dalam perkara tahun 2010, menurutnya adalah perbuatan yang tidak benar dan merupakan tindakan perbuatan melawan hukum.
“Dalam gugatannya itu secara sengaja tidak menyebutkan alamat yang digugat (kami), itu kurang hati – hati atau disengaja, ” Jelas Indria.
Lebih lanjut dikatakannya bahwa mereka sudah tahu tanah tersebut telah ber-sertifikat, itu tidak disebutkan pada sidang PTUN. Mereka menyebutkan dan menggunakannua sebagai alat bukti berupa tanah bebas atau tanah negara (2010)
“Isinya justru menghukum penyewa (PT Coral Park) menyerahkan tanah, dan juga karena Pemda (Pemkab Buleleng) tidak dimasukan sebagai pihak tentu kita kehilangan hak kita, disini (gugatan Perdata Nomor 495) kita meluruskan sebenarnya, ” Ungkapnya.
Pada sidang PTUN pada dasarnya yang digugat adalah tata usaha negara yang menjadi objek gugatan pada prinsipnya adalah Keputusan/Tindakan Badan atau Pejabat Pemerintahan yang bersifat administratif.
Karena itu, apabila yang dipersoalkan adalah keputusan pertanahan yang diterbitkan oleh BPN, maka BPN atau pejabat yang menerbitkan keputusan tersebut mempunyai posisi penting dalam perkara PTUN.
“Karena pemerintah memiliki hak pengelolaan maka dikirimilah surat oleh PTUN, yang disana pemerintah sebagai pihak tergugat intervensi (pihak ketiga yang dilibatkan dalam suatu perkara) kemudian masuk dalam gugatan, ” Terang Indria.
Dirinya juga menerangkan secara jelas bahwa ini tidak ada kaitannya dengan putusan PTUN.
Dengan kata lain, putusan PTUN tidak otomatis menjadi objek gugatan baru di PN. Yang dapat dipersoalkan dalam perkara berbeda adalah tindakan atau perbuatan yang dilakukan para pihak setelah atau di luar putusan tersebut, sepanjang memenuhi dasar dan kewenangan pengadilan yang bersangkutan.

Bila gugatan perbuatan melawan hukum ini menang makan ada upaya hukum lainnya yakni peninjauan kembali atas putusan PTUN yang telah diterbitkan. Disinilah pihak Polres Buleleng wajib mentaati asas hukum Prejudicieel geschil, yakni suatu persoalan keperdataan wajib diutamakan baru pemeriksaan pokok perkara (Pidana) dapat dilanjutkan.
Bila saja Putu Agus Suradnyana (mantan bupati) menyerahkan tanah tersebut kepada masyarakat tentu itu menjadi pidana.
“Itu terbit juga dasarnya adalah temuan BPK, tapi perlu diketahui apapun itu bila ada gugatan dapat dibatalkan penetapannya, sepengetahuan dapat membuktikan keabhsahannya, ” Pungkasnya.
