BADUNG – Buildings offered for rent, such as offices, hotels, apartments, and boarding houses, must be properly maintained and kept in safe condition. Even minor structural damage can lead to fatal consequences.
This reality was experienced by Sebastian Chiti, a 33-year-old U.S. citizen living and working in Kuala Lumpur, Malaysia, during his stay at the Anantara Seminyak Bali Resort in Badung Regency.
According to his legal representative, Hezkiel Paat, Chiti sustained serious injuries after falling from the 5th floor of the resort. The incident occurred on the evening of Saturday, February 4, 2023, when Chiti left his room (Room 505) intending to dine at the rooftop restaurant. However, the elevator to the rooftop was out of service.

“He found an open door leading to a stairwell, from where he could clearly hear music coming from the rooftop,” Paat explained during a press meeting in Seminyak on Monday, March 20, 2023. “There were no warning signs, ‘no entry’ notices, or danger markers near the stairs.”
Believing it was the only way up, Chiti began climbing. Midway, one of the steps broke, causing him to plummet from the 5th floor onto a concrete area below, where large stones, metal equipment, and shards of glass were scattered.

Chiti was rushed to Siloam Hospital Denpasar with multiple severe injuries, including deep open wounds requiring surgery, fractures to his leg and elbow, and swelling in both legs. He underwent surgery on February 5, 2023, followed by physiotherapy.
On February 9, doctors declared he could continue treatment in Malaysia. The next day, he was flown to Kuala Lumpur and admitted to Prince Court Medical Center until February 17, where additional diagnoses revealed muscle damage and a torn ligament in his left leg, as well as acute stress reaction.

Despite the gravity of the incident, Paat stated that the hotel neither issued an apology nor opened discussions about compensation. Instead, the management charged Chiti the full cost for his three-night stay—even though the accident nearly claimed his life.
“We are considering legal action,” Paat concluded.
As of publication, hotel management could not be reached for comment due to the proximity of the Nyepi holiday. (Ray)
